Refers to any individual who accesses or interacts with a Customer’s deployment of the Service, including but not limited to attorneys, litigants, witnesses, observers, jurors, or members of the public.

1.3 “Service”
Refers to HCI software, applications, and related technologies, including but not limited to Liberty Virtual Courtroom and associated components.


2. Role of High Criteria, Inc.
2.1 HCI develops and provides technology solutions used by Customers.

2.2 In many cases—particularly with Liberty Virtual Courtroom—HCI acts as a technology provider, not the system of record.

2.3 The Customer:
  • Determines how the Service is used
  • Controls how data is collected, stored, accessed, and retained
  • Acts as the data controller (or equivalent authority) for case-related data

2.4 Participants access the Service at the direction of the Customer.

2.5 HCI does not control how case-related data (including recordings, transcripts, or evidence) is used or retained by the Customer.


3. Information We Collect
We may collect personal information in the following contexts:

3.1 Website and Online Service Usage
When you access our websites or applications, we may collect:
  • IP address
  • Browser type and device information
  • Operating system
  • Usage activity and preferences
This information is used to operate, secure, and improve our services.

3.2 Requests, Orders, and Support
When you interact with us directly, we may collect:

4. Liberty Virtual Courtroom (LVC)
4.1 General Context
Liberty Virtual Courtroom is used by Customers to conduct proceedings and manage participants. The Customer controls how the Service is used, including recording and retention.

4.2 Information Provided by Participants
Participants may optionally provide:
  • Name
  • Case number or reference information
  • Role or designation
This information is used to identify participants within a session and may be included in session logs.

4.3 Automatically Collected Information
We may collect limited technical data necessary to operate the Service, including:
  • IP address
  • Device and browser type
  • Operating system
  • Session connection and disconnection timestamps
  • Duration of participation
  • Network and performance metrics
This information is used strictly for:
  • Service operation
  • Security
  • Troubleshooting
  • Performance optimization

4.4 Telephony Participation
If a Participant joins via telephone, we may collect:
  • Calling phone number (when available)
  • Call metadata (e.g., duration, connection status)

4.5 Customer-Controlled Data
All recordings, transcripts, exhibits, and case-related materials are controlled by the Customer.
HCI:
  • Does not own this data
  • Does not use it for independent purposes
  • Does not act as the official record custodian
Retention, access, and disclosure are determined solely by the Customer.


5. How We Use Personal Information
We use personal information to:
  • Provide and operate our services
  • Maintain security and system integrity
  • Respond to requests and provide support
  • Manage business relationships
  • Improve and develop our products and services
  • Conduct internal analytics and business operations
Where required, processing is based on contractual necessity, legitimate interests, or consent.

7.3 HCI does not control third-party data collection practices and encourages review of those policies.

8.2 For Liberty Virtual Courtroom:
  • Recordings and case-related data are typically stored in Customer-controlled environments
  • HCI does not maintain a centralized repository of official records


9. Data Retention
9.1 HCI retains personal information only as long as necessary to:
  • Fulfill the purposes described in this Policy
  • Comply with legal and regulatory obligations
  • Resolve disputes and enforce agreements

​9.2 For Liberty Virtual Courtroom:
  • Retention of recordings and case-related data is determined solely by the Customer
  • HCI retains limited operational logs for security, troubleshooting, and service reliability


10. Your Rights
Depending on your jurisdiction, you may have the right to:
  • Access your personal information
  • Correct or update inaccurate information
  • Request deletion of your data
  • Object to certain types of processing
To the extent permitted by law, Participants should direct requests related to case data to the Customer, as HCI does not control such data.


11. International Transfers
HCI operates globally and may process personal information in jurisdictions outside your own. Where required, appropriate safeguards are implemented.
